1. Scope of application
The following General Terms and Conditions of Business (GTC) apply to the use of this website and the business relations between Dieutaime and its customers in the version that is currently available and valid when the website is accessed or when goods ordered. The offer on this website is directed exclusively to customers with Swiss residence.
A customer defines as any natural or legal person who maintains business relations with Dieutaime. The General Terms and Conditions, the Terms of Delivery and Payment, and the Privacy Policy may be amended from time to time. Dieutaime asks you to read these provisions carefully each time you visit the website and order goods.
These terms and conditions apply exclusively. Conflicting, supplementary, or deviating terms and conditions require the express written confirmation of Dieutaime to be valid. By using this website or ordering goods, the Customer confirms that he/she accepts this GTC, including delivery and payment conditions in full.
Should individual provisions of these GTC prove invalid or impracticable, the validity of the remaining provisions remains unaffected.

2. Information on this website
Dieutaime contains information about products and services. We reserve the right to make changes to prices and product range as well as technical changes. All information on (product descriptions, illustrations, films, dimensions, weights, technical specifications, accessory relations, and other information) are to be understood as approximate values only and in particular do not represent any assurance of properties or guarantees unless explicitly stated otherwise. Dieutaime makes every effort to ensure that all data and information on this website is correct, complete, up-to-date, and arranged; Dieutaime cannot guarantee this either explicitly or implicitly.
All offers on this website are subject to change without notice and should not construe as a binding offer.
Dieutaime cannot guarantee that the products listed are available at the time of ordering. Therefore, all information regarding availability and delivery times are without guarantee and are subject to change at any time and without notice.
3. Prices
The prices quoted by Dieutaime are net in Swiss Francs (CHF).
Unless otherwise provided, any shipping costs will be charged additionally and paid by the Customer. Shipping costs are shown separately in the order process.
Technical changes, errors, and misprints are reserved. In particular, Dieutaime may change prices at any time and without notice. No consulting and support services included in the sales prices.
4. Conclusion of the contract
The offers on this website represent a non-binding invitation to the Customer to order products and/or services from Dieutaime. By placing an order via this website, including the acceptance of these General Terms and Conditions, the Customer submits a legally binding offer to conclude a contract. Orders placed are binding for the Customer. Unless otherwise noted, there is no right of return or withdrawal.
The contract concluded soon as Dieutaime sends an order confirmation by email, in which the dispatch of the ordered products or services confirmed under the corresponding conditions.
Orders will only be delivered after full payment has been received and provided the goods are available. If, after the contract concludes, it transpires that the ordered goods cannot be delivered or cannot deliver in full, Dieutaime shall be entitled to withdraw from the entire contract or a part of the contract. If Dieutaime has already received the Customer’s payment, the payment will be refunded to the Customer. If payment has not yet made, the Customer shall release from the obligation to pay. Dieutaime is not obliged to make a replacement delivery in the event of termination of the contract.
5. Payment options and retention of title
The Customer has the payment options indicated in the order process at his disposal. The Customer shall bear any fees in connection with individual payment options. Dieutaime reserves the right to exclude customers from individual payment options without giving reasons or to insist on advance payment.
Dieutaime may charge interest on arrears of 5% per annum and a reminder fee of a maximum of CHF 20 per reminder if the Customer is in arrears. The products delivered to the Customer shall remain the property of Dieutaime until full payment been received.
6. Delivery, Obligation to Inspect, Notice of Defects and Return
Deliveries are sent by mail or courier service to the address indicated by the Customer in the order. Invoicing is done by email or by post. With the dispatch, benefit and risk are transferred to the Customer, as far as this is legally permissible. If the delivery cannot be delivered or if the Customer refuses to accept the delivery, Dieutaime may, after notifying the Customer of a complaint by email and setting a reasonable deadline, terminate the contract and charge the Customer for the costs of the work involved.
The Customer is obliged to inspect the delivered goods immediately after receipt of the delivery and notify Dieutaime immediately in writing by letter or email to the address in the (>Imprint) of any defects for which Dieutaime provides a warranty.
Returns to Dieutaime shall be at the Customer’s expense and risk. The Customer shall return the goods in their original packaging, complete with all accessories, and the delivery note and a detailed description of the defects to the return address specified by Dieutaime in the (>Imprint).
Suppose Dieutaime’s inspection reveals that the goods do not have any detectable defects or that the manufacturer’s warranty does not cover them. In that case, Dieutaime may charge the Customer for the work involved, the return shipment, or the possible disposal.
7. Right of withdrawal
The Customer is granted a right of withdrawal during ten calendar days after receipt of the goods. The deadline deemed to have been met if the Customer sends the written revocation to Dieutaime by email (>address) within the deadline. The revocation does not require any justification.
The exercise of the right of revocation shall lead to a rescission of the contract. The Customer must return the goods within ten calendar days in their original packaging, complete with all accessories, and together with the delivery note to the return address specified by Dieutaime in (>Imprint). Return shipments to Dieutaime shall be made at the Customer’s expense and risk. Any payment already made shall be refunded to the Customer within 20 calendar days, provided that Dieutaime has already received the goods back.
Dieutaime reserves the right to demand appropriate compensation for damage, excessive wear and tear or loss of value due to improper handling and to deduct the reduction in value from the purchase price already paid or to charge the Customer for such reduction in value.
In the following cases no right of withdrawal is granted:
1. if the contract concerns a movable item that is manufactured according to the consumer’s specifications or is clearly tailored to personal needs.
2. if the subject of the contract is a service and the contract is to be fully performed by the provider with the prior express consent of the consumer before the withdrawal period has expired.
8. Warranty
In the event of defects notified in good time, Dieutaime shall warrant that the item purchased by the Customer is free of defects and functional during the statutory warranty period of generally two years from the date of delivery. It is at Dieutaime’s discretion to provide the warranty by free repair, equivalent replacement, or refund of the purchase price. Further claims excluded.
Normal wear and tear and the consequences of improper handling or damaged by the Customer or third parties, as well as defects attributable to external circumstances, are not covered by the warranty. The warranty for consumable and wearing parts are also excluded.
Dieutaime is not able to give any assurances or guarantees for the timeliness, completeness, and correctness of the data or for the constant or undisturbed availability of the website, its functionalities, integrated hyperlinks and other contents. In particular, no representations or warranties are made that use of the website will not infringe rights of third parties not owned by Dieutaime.
9. Liability
Dieutaime excludes all liability, regardless of its legal basis, as well as claims for damages against Dieutaime and any auxiliary persons and vicarious agents. In particular, Dieutaime shall not be liable for indirect damage and consequential damage, loss of profit or other personal injuries, property damage, or pure financial loss of the Customer. The right is reserved for a further-reaching mandatory legal liability, for example, for gross negligence or unlawful intent.
Dieutaime uses hyperlinks only for the simplified access of the Customer to other websites. Dieutaime can neither know the content of these web offers in detail nor can it assume liability or other responsibility for the content of these web pages.
10. Data protection
Dieutaime may process and use the data recorded within the scope of the conclusion of the contract to fulfill the obligations arising from the purchase contract and may use the data for marketing purposes. The data necessary for services’ performance may also be passed on to commissioned service partners (logistics partners) or other third parties.

11. Further provisions
Dieutaime expressly reserves the right to change these terms and conditions at any time and put them into effect without notice.
In the event of disputes, only substantive Swiss law shall apply, to the exclusion of conflict-of-law provisions. The UN Sales Convention (CISG, Vienna Sales Convention) is explicitly excluded.
The place of jurisdiction shall be Dübendorf unless the law provides for compulsory places of jurisdiction.
